Contract
Contracts are concluded in the name of Chain Lube Systems and are based soley upon these Conditions of Sale. All agreements must be in writing. This applies equally to secondary agreements and assurances as well as to subsequent alterations to the Contract.
Prices
Advertised prices are net prices and are given in Euros (€) or Pound inclusive of statuatory Value Added Tax. Following publication of new brochures all previously advertised prices cease to be valid.
Retention of Title
The goods remain the property of Chain Lube Systems until full payment of all claims has been received in accordance with the terms of business. The Purchaser may not make use of or dispose of the goods. In the case of actions by third parties the retention of title must be drawn to their notice immediately.
Warranty / Liability
Once used, warranty of the goods is limited to the right of repair. A price reduction or refund may be sought only in the event of unsuccessful repair. The validity of the warranty extends beyond the statuatory period to 3 years from the date of receipt of the goods. Compensation claims for direct or indirect damages may not be pursued, so far as we are not accused of intentional or gross negligence. In all cases, when making a claim under warranty or for liability the original receipt of purchase must be presented.
Return and Exchange of Unused Goods in New Condition
Purchasers are granted a period of 2 weeks for the return of unused goods in new condition, at the price current at the date of order, when goods are returned with a valid receipt of purchase. This right does not apply to special orders or custom made goods.
Carriage and Packaging / Delivery
Carriage and packaging is offered subject to the Purchaser meeting the appropriate additional costs.
Rights Reserved
We reserve the right to alter the price or the product specification without prior notification. We reserve the right to decline orders from customers or not to supply goods in the absense of suitable means of delivery. The recommended retail price is that given in the brochure.
Data Protection
Your personal data relative to the order is stored and processed soley for the purpose of handling your order. In accordance with the provisions of the Federal Data Protection Act we are committed to the fullest protection of your data.
Applicable Law
All Sale Agreements concluded with us, together with any disputes arising therefrom, shall be governed by the Laws of the Federal Republic of Germany except where such Agreements are governed by the provisions of international private or civil law rulings.
Place of Jurisdiction
The place if Jurisdiction is Coburg.
The sale of our goods is subject to acceptance of these Conditions of Sale.
